PHOENIX (3TV/CBS 5) – Phoenix authorities said they detained the man who had been struck by a gas round throughout the Trump protest following kicking a gas could toward officers on Tuesday night.

Police said he’s still being interviewed and has not been booked on any fees.  

He asked us not to use his title, when 3TV/CBS 5 talked to him on Wednesday. Phoenix police haven’t identified him.

The man was captured on video, which has since gone viral, blowing off a can of tear gas down . They returned the favour with a round that struck on him and then he went right to the floor.

He was assisted by A man in a Colin Kaepernick jersey out.

He spent Tuesday night in the emergency area for inhaling pepper spray plus second-degree burns from picking up a can of tear gas.

The incident happened after authorities said protesters threw rocks, bottles and gas so that they used tear gas and pepper balls to spread the crowd.

We talked to an attorney on Wednesday who said as it could be challenging to prove he attempted to harm an officer, the protester would not face any legal problem for kicking against the tear gas back.  

The protester stated he didn’t intend to hurt anyone.
